1. Agreement to these terms
By creating an account or using Alpine ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you are using Alpine on behalf of a business, you represent that you have authority to bind that business to these Terms.
Alpine is operated by Evergreen Digital LLC, a limited liability company registered in Nebraska ("Evergreen Digital," "we," "us," or "our").
If you do not agree to these Terms, do not use the Service.
2. The Service
Alpine is an AI-powered SEO tool that provides keyword research, content generation, SEO recommendations, and related tools for small businesses. The Service is provided on a subscription basis.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice. We will not materially reduce the core functionality of your current plan without notice.
3. Accounts
Creating an account
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at brett@evergreendgtl.com if you suspect unauthorized access.
One account per business
Each account is for use by a single business entity. You may add seats for additional team members under your account as permitted by your plan.
Account eligibility
You must be at least 18 years old to create an account. The Service is intended for use within the United States.
4. Subscriptions and billing
Plans
Alpine is offered on paid subscription plans. Current plan details, pricing, and included features are described on our pricing page. We may change pricing with at least 30 days' notice to existing subscribers.
Billing
Subscriptions are billed in advance on a monthly basis. Payment is processed through Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis until you cancel.
AI action credits
Each plan includes a monthly allotment of AI actions (Claude API calls, including chat messages, content generations, and keyword analyses). Your usage resets at the start of each billing cycle. Unused credits do not roll over.
If you exceed your included allotment, you may purchase additional AI action packs as one-time purchases. These are non-refundable and valid for the current billing period only.
Additional seats and sites
You may add seats and additional connected sites to your subscription. These are billed as additional line items on your subscription at the rates shown in your account settings.
Cancellation
You may cancel your subscription at any time from your account settings or by contacting brett@evergreendgtl.com. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months.
Refunds
We offer a full refund within 7 days of your initial subscription purchase if you are not satisfied with the Service. After 7 days, all charges are final except where required by law. One-time AI action pack purchases are non-refundable.
5. Third-party integrations
Google services
Alpine allows you to connect Google Analytics, Google Search Console, and Google Drive to your account. By connecting these services, you authorize Alpine to access data from those services on your behalf under the permissions you grant.
You may disconnect Google integrations at any time. We are not responsible for any changes Google makes to its APIs, data availability, or terms of service that affect the functionality of these integrations.
Stripe
Payment processing is handled by Stripe. By using the Service, you agree to Stripe's terms of service.
Anthropic
AI-powered features use the Anthropic Claude API. Content generated by AI is subject to Anthropic's usage policies.
6. Acceptable use
You agree not to use Alpine to:
Violate any applicable law or regulation
Generate content that is defamatory, fraudulent, or infringes on third-party intellectual property
Attempt to reverse engineer, scrape, or extract data from the Service in ways not permitted by these Terms
Use the Service to develop a competing product
Exceed your plan's usage limits by automated or artificial means
Share your account credentials with users outside your authorized seats
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Content ownership
Your content
You retain ownership of all content you create, upload, or generate through the Service, including blog posts, press releases, Knowledge Base notes, and business information. By using the Service, you grant Evergreen Digital a limited license to process and store your content solely to provide the Service.
AI-generated content
Content generated by Alpine's AI features is provided to you for your use. You are responsible for reviewing AI-generated content before publishing it. We make no guarantees about the accuracy, originality, or SEO effectiveness of AI-generated content. You should always fact-check and edit AI-generated content before use.
Our content
All other content in the Service — including the software, interface, branding, and documentation — is owned by Evergreen Digital and protected by intellectual property law. You may not copy, modify, or distribute it without our written permission.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
The Service will meet your specific SEO goals or business objectives
AI-generated recommendations will improve your search rankings
The Service will be uninterrupted, error-free, or secure
Data from Google integrations will be accurate or complete
SEO results depend on many factors outside our control, including search engine algorithm changes. We make no guarantees about ranking improvements or traffic outcomes.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERGREEN DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Evergreen Digital LLC and its members, officers, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Governing law and disputes
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Lancaster County, Nebraska, and you consent to personal jurisdiction in those courts.
Before filing any legal claim, you agree to contact us at brett@evergreendgtl.com and attempt to resolve the dispute informally for at least 30 days.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before the effective date.
13. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay your subscription, or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. We will retain your data for 90 days following termination before deletion, during which time you may request an export.
14. Entire agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Evergreen Digital LLC regarding the Service and supersede any prior agreements.
